Acceptance of the general conditions of sale – Modifications

Access to the Website, as well as the procedures for consulting and using it, are subject to the unreserved acceptance of these general terms and conditions of sale and use. Confirmation of an order entails full and complete acceptance of these terms and conditions.
These general conditions may be subject to modification at any time; the applicable conditions are those in force and available on the Website on the date of access and consultation of this Website by the user.

Buy a work

Each work presented on the Site is accompanied by a complete description of its characteristics, its price, its geographic location department and the delivery costs to be paid by the buyer. To purchase a work, simply place it in your basket (“Add to basket”), confirm your order (“Complete my order”) and pay the price (“Payment”).

Sales contract

In accordance with the provisions of the Civil Code relating to the conclusion of online contracts, the contract will be concluded when you click on the button allowing you to confirm your order after having viewed the details of it and in particular its total price and having had the opportunity to correct any errors. You will thus acknowledge your obligation to pay.

Contracts entered into on our website (data relating to your orders and the General Terms and Conditions in effect on the date of your order) are archived for a period of 10 years. Confirmation of orders

A confirmation email is sent to the buyer within one business day of the order being placed. Since each work is unique or reproduced in limited quantities, the sale is always concluded subject to the suspensive condition of its availability.

Assignment of copyright

In the event of acquisition of one of his works by a client of the Site, the Artist transfers to the purchaser, without limitation of duration, the support of the work considered, as well as all the patrimonial rights attached to it, namely the right of representation and reproduction within the framework defined below, in accordance with the provisions of article L. 122-7 of the Intellectual Property Code , and to retain only his moral rights.

The purchaser may exhibit the work in any location of his choice, present it to the public, including to a remote public, transfer it, lend it or rent it.

Price of works

The price of each work indicated on the Site is expressed in euros and dollars, all taxes included. This price is increased by any costs of provision and delivery (packaging, shipping, insurance, etc.) that may be due.

The price of a work may be changed at any time, upwards or downwards. The invoiced price corresponds in all cases to the price displayed on the Site at the time the order is validated by the buyer.

In the event of delivery to a country other than France, its overseas territories or outside the European Union, the price invoiced is the price excluding taxes. If customs duties, local taxes or import duties are payable, these duties are the responsibility of the buyer and are their sole responsibility, both in terms of declarations and payments to the competent authorities and/or organizations. It is their responsibility to inquire with the competent authorities.

Payment methods

Payment can be made in the following ways:

  • by credit card,
  • by Paypal

The transfer of ownership of the work occurs after full payment of the price and its accessories.

In the event of non-payment for any reason whatsoever, the sale will automatically be terminated and the work put back on sale.

In the event that the buyer has chosen to benefit from the possibility of payment in three installments and does not honor at least one of the scheduled payments, he will be required to return the works to the Company, and the latter will retain the full amount of the payments already made, as a penalty clause.

Delivery of works

The delivery time within mainland France is a maximum of 60 days from the validation of payment to the Site. This maximum delivery time is increased to 90 days for all other locations.

Delivery is made to the address indicated by the buyer on the order form, during business hours.

Delivery costs and additional costs depend on the nature of the work, its overall dimensions, its weight and the place of delivery.

Reserves

The buyer undertakes, upon receipt, to unpack and check the condition of the work in the presence of the carrier and to express any reservations he deems necessary to the latter, in writing and without delay, and at the latest within 48 hours by email addressed to: bonjour@la-consigne.com

Any product not subject to reservations communicated by registered letter with acknowledgement of receipt within 3 days of its receipt to the carrier, in accordance with article L. 133-3 of the French Commercial Code , and a copy of which will be sent simultaneously to the Site, will be considered accepted by the customer.

Conformity of works

The works sold on the Site are all original. A certificate of authenticity issued by the Artist, author of the work, will be given to the buyer.

If these are limited edition works, they are reproduced in a quantity that complies with the applicable rules and are regularly numbered.

Right of withdrawal and return

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the last good.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement:

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

You must return the work in its original packaging and return it to the artist who sent it, along with proof of tracking, no later than fourteen days after you notify us of your decision to withdraw from this contract. This deadline is deemed to have been met if you return the item before the expiry of the fourteen-day period.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) no later than fourteen days from the date on which the artist received the work. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you expressly agree otherwise; in any event, you will not incur any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof of having sent back the goods, whichever is the earliest. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Editorial information

The Site distributes various editorial content (articles, files, practical information, etc.) produced by itself. These contents and services are provided for informational purposes only. While it undertakes to implement all means at its disposal to offer Internet users quality content and services, La Consigne does not, however, guarantee the completeness, accuracy or updating of said content and services.

The Site may contain hyperlinks to third-party sites. The choice to activate these links is the sole responsibility of the user of the Site, who is informed that the Site exercises no control over these sites and their content, and declines all responsibility for their access, content, availability or use, as well as for the consequences of any nature that may result from their consultation.
